Status: Labor & I-140 approved
EB2: Labor got approved November 2009.
I'm trying to file 1-140 amendment with EB3 priority date. Currently i'm thinking of going with Sheela Murthy/Rajiv Khanna,
could you please suggest some good attorney who can handle my case very well in a limited time? Thanks a lot and really

Hi,
My current H1 is valid till Feb 15 2010. My lawyer filed for H1 extension in Aug 2009, almost 6 months before the visa expiration date.
After 3 months my lawyer filed an enquiry with the CIS and CIS responded back saying they had sent an RFE on Dec 16th 2009 to my employer. However, my employer hasn't received any mail from CIS. Then my lawyer requested the CIS to send another copy of the RFE on Dec 30th 2009.
However, till date nothing has been received in the mail. Is there any way I can get to know what RFE has been issued by CIS?
It has been 6 months since filing my extension at CIS CSC and uptil now there is no news. Can CIS get any worse when it comes to H1 extensions..I don't think so.

Below is my situation;
Last project ended July 17 and am out of project since then and my last pay check was for the week of July 17. I was sent a termination letter and my employer said that he will not revoke my H1B and told me to transfer my H1B ASAP. I have been trying to do a H transfer from then on but no company is willing to do since I don't have a project and every one told to find a project first.
Finally I found a project but now employers are not willing to do a transfer saying that I don't have pay stubs for almost two and half months. A few employers are suggesting to file a new H1B.
What would be the best course of actions in my situation.

For me it took 1.5 months. I visited the consulate to check the status. Typically you can check the status of your passport renewal from CGI mail room. They can tell you whether your passport is processed, mailed etc.
Unfortunately CGI Houston has very poor customer service. They won't answer your calls or reply to your emails.

Does the published cumulative demand data represent
a) all pending 485 cases that include primary applicants and their dependents
OR
b) all pending 485 cases that include primary applicants only?
If say, the demand data for EB3, till 2004 says 35,000 - does this mean there are a total of 35,000 pending cases in total OR does this represent primary applicants only?
If it represents primary applicants only, what is the multiplication factor we need to use to get an approximate number for total pending 485 cases?

Hi All,
My OPT expires on March 20th 2012. According to USCIS rules, I am on valid F-1 status 2 months after OPT expiration. "nonimmigrant F�1 students on post-completion OPT maintain valid F�1 status until the expiration of the OPT period and the subsequent 60-day departure preparation period".
Is it possible for me to take advantage to cap-gap after expiration of OPT as I will still be on valid status? Can I quit work for 10 days after my OPT expiration and start working again on April 1st after a employer files my H-1?
Please advise.

My lawyer just told me, that Canadian citizens have the privilege to get H-4 stamped at the border & do not need to go the US consulates in Canada. Just wanted to ask that if this true and if someone has been through it.
Are there specific Land Borders where stamping can be done? or does it works at every Border post?
Is there a border post in the Minnesota or North Dakota area where this can be done? My wife lives in a small town in Manitoba.
Does she have to take all her pictures or will they take picture there for the visa? & what else would we need? non-immigrant forms etc. Any experiences?? I know they will need my H-1 Petition copy, pay stubs, marriage certificate, pictures of marriage etc.

My Wife had her COS from H4-H1, and I filed my I-485 in July with my wife as secondary applicant and already got our EAD,AP. We are planning to Visit India this month and my wife wants to use her AP while travelling back to US.
1. Is it advisable or are there any issues with using AP.
2. Can she use AP that she received as a secondary applicant and continue to work on H1B with her current employer
3. In Case her Status changes to EAD, can we reinstate her H1B at any point in time without counted against H1B Cap.
Pl Advise.
